These Terms and Conditions govern your use of the RideRush app and services. By accessing or using the RideRush platform, you agree to comply with and be bound by these terms. If you do not agree with these terms, please refrain from using the app.

1. General Overview

RideRush connects passengers with drivers of rental vehicles for group rideshare services. The app allows users to schedule and share rides, calculate per-person fares, and use various features like party van customization, navigation to local venues, and social ride invitations.

2. Eligibility

You must be at least 13 years old to use the RideRush app. By accessing the platform, you confirm that you are legally capable of entering into binding agreements.

3. User Accounts

To use the RideRush app, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account details and all activities that occur under your account.

4. Hold Harmless Agreement

By using the RideRush service, you agree to hold RideRush harmless in the event of any accident, injury, or damage that occurs during your ride. All liability and coverage for any bodily injury, property damage, or claims arising from an accident will be the responsibility of the driver or their insurance provider. RideRush will not be held liable under any circumstances for any incidents that occur during the rental, including but not limited to personal injury, vehicle damage, or third-party claims.

6. Ride Payment and Cancellation

Fares are calculated on a per-person basis and must be paid via the RideRush app prior to the ride commencing. Once the ride has been confirmed, it is non-refundable, except in the case of app malfunction or service unavailability.

Cancellation policies are as follows:If the ride is canceled within 1 hour before the scheduled time, no cancellation fee will apply 

• No-shows or last-minute cancellations within 1 hour of scheduled time will result in a full charge.

7. User Conduct

Users must respect drivers, fellow passengers, and the property of RideRush and its partners. Any behavior deemed abusive, threatening, or unlawful will result in account suspension or termination, without refund.

Prohibited Conduct:

• Tampering with or damaging the rented vehicle.
• Inappropriate behavior toward the driver or other passengers.
• Using the app for illegal activities or fraudulent purposes.

8. Vehicle Condition and Use

The vehicles rented by RideRush are to be used for transportation purposes only. Any damage, vandalism, or inappropriate use of the vehicle will result in the user being held fully responsible for repairs or replacement costs. RideRush reserves the right to charge users for any damage caused to the vehicle during their rental or ride.

9. Limitation of Liability

To the fullest extent permitted by law, RideRush is not responsible or liable for:

• Any indirect, incidental, special, punitive, or consequential damages arising out of or in connection with the use of the app or services.
• Any errors, omissions, or interruptions in the availability of services.
• Any damage to personal property or injury to persons arising from the use of RideRush’s services.

RideRush’s liability will, in any event, be limited to the amount paid by you for the services used.

10. Third-Party Services

The RideRush app may include links to third-party websites or services that are not owned or controlled by RideRush. We are not responsible for the content, privacy policies, or practices of any third-party websites or services.

11. Termination

RideRush reserves the right to terminate or suspend user accounts at any time, for any reason, including but not limited to violations of these Terms and Conditions, fraudulent activity, or non-payment.

12. Indemnification

You agree to indemnify, defend, and hold RideRush and its affiliates, officers, agents, and employees harmless from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use of the RideRush app or services.
• Your breach of these Terms and Conditions.
• Your violation of any law or third-party rights.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms and Conditions will be resolved through binding arbitration in accordance with the rules of said state, rather than in court. However, RideRush reserves the right to seek injunctive or other appropriate relief in a court of competent jurisdiction if necessary.

14. Changes to Terms

RideRush reserves the right to modify or update these Terms and Conditions at any time. Your continued use of the app after any changes signifies your acceptance of the revised terms. It is your responsibility to review these terms regularly.
